Authorized Resale Policy

DTS MG Co, Inc and Emak Beauty, LLC hereby adopts this Resale Policy and requires that each person, firm, or entity (as applicable, a “Reseller”) that purchases GENOSYS products for resale agree to comply with this Policy.

• Sales to End Users Only. Unless otherwise agreed with Brand Owner in writing, the Reseller may only purchase Products for resale to consumers and end-user customers. The Reseller may not resell Products to other Resellers, distributors, or for further distribution in any manner.

·         No Sales on Online Marketplaces. The Reseller may not advertise or sell the products online on any e-commerce platform, specifically including, but not limited to, Amazon, eBay, Walmart, etc. drop-ship accounts (e.g., Buy.com, Jet.com, Newegg, etc.) or classified sites (e.g., Craigslist, Facebook Marketplace, etc.). This is strictly prohibited. However, the Reseller may advertise the products on its own website or social media sites as long as the end price is not exposed. Exposing a price online is opposed to our Policy

• Reseller Website. The Reseller may sell Products on its own website only if the price is not exposed or password protected.

• Compliance with MAP. The Reseller should adhere to “minimum advertised price” or “MAP” or other Policy that restricts the minimum price at which a product may be advertised.

Any Reseller that fails to comply with this Policy will be deemed an unauthorized reseller of the Products, and as such, shall have no right to:

        i.            sell the Products,

      ii.            use Brand Owner’s intellectual property, including any of its trademarks or copyrights, or

    iii.            offer Brand Owner’s consumer warranty applicable to any of the Products.

RESELLERS THAT FAIL TO COMPLY WITH THE FOREGOING TERMS FORFEIT THE RIGHT TO SELL THE PRODUCTS.
